Terms and Conditions

These Terms and Conditions apply to everyone who uses VIPpass: the website, the waitlist, checkout pages, the fan membership page, the creator app, the VIPpass Telegram bot and the messages we send. They work together with our Privacy Policy, our Fan Policy for people who buy access and our Creator Policy for people who sell it.

If one of those policies says something more specific about its subject than these terms do, the more specific policy applies.

You accept these terms by using VIPpass. Fans accept them at the entry gate before every checkout. Creators accept them before setting up an account. We record which version you accepted and when.

VIPpass ("we", "us") runs this website, the creator app, checkout and the VIPpass bot. You can reach us at [email protected].

VIPpass is a tool for verified adult creators who run private Telegram groups or channels, WhatsApp groups or Snapchat private stories. We verify creators, take payments from fans, grant access, track when each membership ends, remove expired members on Telegram, and pay creators out.

We collect each payment on the creator's behalf, keep the service fee and pay the rest to the creator. The creator is the one selling access to their space, and is responsible for what they post in it.

• We do not host content. Creator content stays on the creator's own Telegram, WhatsApp or Snapchat account. We never receive, store or check it.
• We do not read your messages. The VIPpass bot only handles membership events, such as join requests and members joining or leaving, and the commands you send it.
• We are not Telegram, WhatsApp or Snapchat. VIPpass is not affiliated with, endorsed by or sponsored by them. Their names belong to their owners.
• We do not offer in-person services and do not allow them to be offered through VIPpass.

You can use VIPpass only if all of these are true:

• You are 18 or older, and old enough to view adult content and enter contracts where you live.
• Using VIPpass, and the content you sell or buy access to, is legal where you live.
• We have not banned you before.
• You use VIPpass for yourself, not on behalf of someone else or to hide who you are.

Creators must also pass identity verification, as the Creator Policy describes. VIPpass is open in a limited number of countries and payment methods differ between them.

Fans do not need an account to pay. When a fan opens the web page to manage their memberships, we send a one-time login code to their phone. Creators log in with a phone number and a one-time code.

Keep your login codes and your phone to yourself. You are responsible for what happens on your account. If you think someone else has used it, tell us straight away.

Each person can have one creator account. Creating a second account, for example to stay on the free plan or to get around a ban, breaks these terms.

When you use VIPpass, you must not:

• Sell, buy, share or ask for anything involving a person under 18, or anyone presented as under 18.
• Sell or share content recorded or shared without the consent of everyone in it, including leaked, hidden-camera or revenge material.
• Offer, request or arrange in-person services, including meetups, escort or massage.
• Use fake payments, stolen cards or someone else's mobile money account, reverse payments dishonestly, or use VIPpass to move money for any reason other than buying or selling access.
• Use another person's identity, ID document, face or payout account, or let someone else use yours.
• Copy, record, resell or re-share paid content or invite links.
• Harass, threaten, blackmail or expose the identity of a creator, a fan or our staff.
• Scrape VIPpass, reverse engineer it, get around its access controls or plan limits, or interfere with the VIPpass bot.
• Use VIPpass in a way that breaks the law or the terms of Telegram, WhatsApp, Snapchat or a payment provider.

Creators also follow the Content Rules in the Creator Policy.

Spaces live on platforms we do not control. Telegram, WhatsApp and Snapchat have their own terms, which you also need to follow, and they can change their features or close accounts at any time. If a platform does this, VIPpass may not be able to deliver or manage access to a space.

On Telegram, VIPpass uses only the official Telegram Bot API. WhatsApp and Snapchat offer no official tools for managing private groups or stories, so on those platforms the creator adds and removes members by hand. We never use unofficial bots or automation for them.

Payments are processed by payment providers who have their own terms. Which providers and methods are available depends on your country.

Fans pay the price shown at checkout. If the service fee is added to the fan's price, checkout shows it as a separate line and shows the total before the fan pays.

Creators pay the service fee and, if they choose a paid plan, a monthly plan price. Both are set out in the Creator Policy and on our pricing section. The service fee covers the payment provider's costs, so there are no other charges from us.

Each payment keeps the fee rate that applied when it was made. A change to fees only affects payments made after it.

Anyone can report a space from its checkout page, from their membership page or with the bot's /report command. Reports are sorted by how serious they are.

• A report that a minor is involved, or that someone did not consent, suspends the space and freezes the creator's payouts straight away, before a person reviews it.
• Three reports from different fans within 7 days, in any category, pause the space for review.
• After a review we reinstate the space, ban the creator permanently or escalate the case.

We may suspend or close any account, space or membership that breaks these terms or that puts people at risk, and ban fans who re-share content or invite links from every space on VIPpass. When we can, we tell you why.

We report suspected child sexual abuse material to the police and to recognised hotlines, and keep the records the law requires us to keep.

Creators own their content. Because we never receive it, these terms give us no rights over it.

Creators let us show their display name, handle, cover image, space descriptions and prices on their checkout pages and in our apps, so that we can sell access for them.

The VIPpass name, logo, website, apps and bot belong to us. You may not use them without our written permission. If you send us ideas or feedback, we may use them without paying you.

Our Privacy Policy explains what personal data we collect, why, who can see it, how long we keep it and how to use your rights.

We work to keep checkout, payments and the bot running at all times, but we cannot promise VIPpass will always be available or free of errors. We may pause it for maintenance, or change, add or remove features.

Joining the waitlist does not guarantee you a creator account. We onboard creators in small groups and may decline an application.

We provide VIPpass as it is. We do not check creator content and are not responsible for what creators post, for its quality, or for whether it matches what a fan expected. The Fan Policy explains what to do if you did not get the access you paid for.

Nothing in these terms takes away rights you have under consumer protection law that cannot be excluded.

As far as the law allows:

• We are not liable for indirect losses, such as lost profits, lost followers or damage to reputation, or for anything caused by Telegram, WhatsApp, Snapchat, a payment provider, or a creator or fan.
• Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. For a fan, that is the price and fees paid for the membership the claim is about.

These limits do not apply to fraud, to death or personal injury caused by our negligence, or to anything else the law does not let us limit.

If someone makes a claim against us because of content you sold, or because you broke these terms, the Fan Policy, the Creator Policy or the law, you will cover our reasonable losses and costs, including legal fees.

You can stop using VIPpass at any time. Fans can cancel renewals as the Fan Policy explains. Creators can close their account as the Creator Policy explains.

We can suspend or close your access if you break these terms, if the law or a payment provider requires it, or if we stop offering VIPpass in your country. Parts of these terms that by their nature should continue, such as the limits on liability, keep applying after your use ends.

We may update these terms. Each version has a number and a date at the top of this page. When a change matters, we tell creators in the app or by email before it takes effect, and the checkout entry gate asks fans to accept the new version before they pay again. If you keep using VIPpass after a change takes effect, the new version applies.

These terms are governed by the laws of the State of Delaware, USA. Disputes go to the state and federal courts located in Delaware, USA, unless the consumer law of the country you live in gives you the right to bring a claim there.

We may publish these terms in French as well. If the English and French versions differ, the English version applies.
